‘Biggest Loser’ star Tara Costa sued for weight gain

A lawsuit was filed against 2009’s Biggest Loser star and plus size model, Tara Costa, after she allegedly breached her contract with FC Online Marketing Inc. due to her 45 pound weight gain.

According to the Wrap, the suit claims Costa, 23, violated a passage in their contract that states her agreement to maintain her current level of fitness and condition during the duration of the deal. In exchange for her image and popularity, Costa was paid $45,000. However, since she gained a noticeable amount of weight, the company felt she no longer could represent the brand in photo shoots or other public appearances.

Costa was a season seven contestant on the Biggest Loser in which she lost 155 pounds. Costa was supposed to visit fifteen franchise location, but Michael Parrella, chief executive of FC, withheld her from making any public appearances.

According to the Huffington Post, back in May, Costa sued FC claiming the company owed her $150,000 plus damages for unauthorized use of her image on the FC owned website, ILoveKickboxing.com. Her suit was later withdrawn.

Costa’s Miami-based lawyer, Darren Heitner told NBC news, “This case has absolutely nothing to do with Ms. Costa’s weight and everything to do with FC Online’s breach of an appearance contract, along with their exploitation of Ms. Costa’s name and image without compensation on a website that promoted their commercial services. Ms. Costa has remained physically fit and even participated in an Ironman competition. FC Online’s effort to frame any debate as one related to Ms. Costa’s appearance is misguided and will be exposed throughout the litigation.”
