The 35-year-old previous Grey’s Anatomy star filed a lawsuit for $6million against Walgreen Co. subsidiary Duane Reade Inc. on Wednesday, April 9.
The actress claimed that the company used her name and image to promote the brand, and a source spoke with Us Weekly and said that she originally tried to settle the issue privately.
“Her attorneys reached out to Duane Reade after [the tweet] was posted,” a source told Us Weekly. “They called and asked for it to be taken down, and Duane Reade ignored them. She tried repeatedly to have this settle without a lawsuit.”
The tweet that Duane Reade had posted included a photo of Heigl carrying their shopping in New City. Duane Reade had used the image on their social media platforms with a Fox News the tweet was posted on March 18.
The complaints that Heigl has against Duane Reade Inc. include misappropriation of her image and false advertising.
“We expect Duane Reade to pay for its willful misuse of Katherine Heigl’s name and likeness,” Peter Haviland said in a press release about the lawsuit according to Us Weekly.
As a response, spokesperson for Duane Reade told Us Weekly they “do not comment on pending litigation.”
Heigl’s attorney also stated that the money from the lawsuit will be donated to a nonprofit foundation that Heigl has worked for years, that organization is the Jason Debus Heigl Foundation. It’s named after the star’s brother who died as a teen in a car accident and aims to help shelter animals who have been abused or neglected.
